02. In the present case, the petitioner seeks bail in connection with Mehsaul O.P. (Town) P.S. Case No. 773 of 2020, registered for the alleged offences under Sections 406, 420, 467, 468, 471, 34 of the Indian Penal Code and Section 138 of Negotiable Instruments Act.

03. As per prosecution case, the informant gave Rs. 10,00,000/- to the petitioner and other co-accused persons in cash or in the bank account for securing a job for her husband in the health department. The co-accused also retained the certificates of Matriculation and Intermediate of the husband of the informant.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence as alleged has ever taken place. From the FIR, it is apparent that specific allegation is against co-accused persons Sagar Kumar Verma and Devendra Sharma. The only allegation against the petitioner is that he and two other coaccused took Rs. 6,00,000/- in cash from the informant. There is no specific allegation against the petitioner for any wrong doing. The petitioner is having clean antecedent and he is in custody since 14.11.2024. Charge-sheet has been submitted.

05. Learned APP for the State opposes the prayer for bail. Learned APP submits that the petitioner has been specifically named in the FIR and he is alleged to have taken money from the informant along with other co-accused persons for securing a job for the husband of the informant.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague nature of allegation against the petitioner and further considering the period of custody of the petitioner and his clean antecedent along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the

No.20264 of 2025(2) dt.23-04-2025 3/3 like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah (Town) P.S. Case No. 773 of 2020, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
