Petitioner seeks bail in Delha P.S. Case No.34 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The police apprehended one Munna Kumar and from his possession about 6 litres of liquor was recovered. On his disclosure, the police proceeded for search of another place where the petitioner Rajesh Kumar was found standing and he was taking out liquor from the ditch. 26 litres of liquor was recovered from the ditch. The petitioner is the brother of Munna Kumar. The petitioner is in jail since 09.02.2020. The petitioner has already remained in jail for more than three months for recovery of only 26 litres of liquor.

Considering the facts aforesaid, the petitioner named

Patna High Court CR. MISC. No.16089 of 2020(2) dt.13-05-2020 2/2 above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Delha P.S.
