JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 365 of the Indian Penal Code. Allegation against the petitioner is of kidnapping brother of the informant.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. The victim has been examined under Section 164 of the Code of Criminal Procedure where he has not named this petitioner. Only material against the petitioner is that his name has come on the basis of confessional statement of the co-accused.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R. but his name has come in course of investigation.

Considering the aforesaid facts, let the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing

Patna High Court Cr.Misc. No.26025 of 2015 (3) dt.22-09-2015 2 / 2 bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Naugachia, in connection with Bihpur (Bhawanipur) P.S. Case no. 361 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
