The petitioner seeks bail in connection with Balliya P.S. Case no. 226 of 2015 (POCSO Case no. 33 of 2015) registered for the offence punishable under Sections 420, 467, 468, 471 and 120B/34 of the Indian Penal Code, 3, 4, 5 and 6 of Immoral Traffic (Prevention) Act and Section 4/8 of the POCSO Act.

The petitioner is said to have been indulged in human trafficking and running the business of flesh trade in his house and two minor girls were recovered from his house. It is submitted by the learned counsel for the petitioner that the girls recovered from the house of the petitioner is nothing else than the own girl of the petitioner and the

Patna High Court Cr.Misc. No.50152 of 2017 (2) dt.17-10-2017 aforesaid girls in their statement under Section 164 of the Cr.P.C. have explicitly stated that they happen to be daughter of the petitioner and they have been released in favour of their grand mother i.e. mother of the petitioner namely, Ojida Khatoon by the learned lower court. The petitioner has been languishing in custody since 6.09.2017 allowed.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, POCSO, Begusarai in connection with Balliya P.S. Case no. 226 of 2015.
