The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 427, 379, 504, 506/34 of the Indian Penal Code and 3(1) (x) (xi) of the S.C./S.T.(Prevention of Atrocities) Act.

Prosecution case is that the informant was working in her paddy field, when petitioners along with to others unknown came and started cutting paddy. On protest being made accused abused and assaulted the informant and demanded Rs. 25,000/- as extortion. It is alleged that accused persons also snatched away ear ring of the informant.

Patna High Court Cr.Misc. No.29266 of 2015 (2) dt.27-07-2015 It is submitted by the learned counsel for the petitioners that petitioner Ganesh Sah lodged Saharsa P.S. Case No. 362 of 2014 with accusation under Sections 387, 341, 147, 149 and 379 of the Indian Penal Codes against the informant. It is further submitted that for the occurrence of 30.08.2014 the First Information Report was registered on 03.09.2014.

Considering the delayed lodging of the case and the accusation levelled in the background of land dispute, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saharsa in connection with S.C./S.T. Saharsa P.S. Case No. 28 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
