JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 This is an application for grant of anticipatory bail in connection with Pirbahore P.S. Case No. 413 of 2013, disclosing offences under Sections 328, 302, 34 of the Indian Penal Code. Prosecution story is that the sister of the petitioner, who is informant, was residing on the first floor and daughter of the informant came down and became unconscious and the informant suspects that the petitioners have administered some poisonous edible materials to her daughter due to that she became unconscious and later on she succumbed to the injury. Submission of learned counsel for the petitioners is that during investigation it has come that the stepmother had thrown a polythene packet in the drainage and the petitioners

Patna High Court CR. MISC. No.18182 of 2019(4) dt.16-05-2019 2/2 have no hand in that and they have given the benefit of police bail during pendency of the investigation.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances of the case as stated above, let petitioners appear and pray for regular bail, which shall be considered by the learned court below on the basis of materials available on record and also the submission that they were on police bail and they have not misused the privilege of police bail and after considering the same, the learned court below shall dispose of the matter, if possible on same day.
