The petitioner apprehends his arrest in connection with Chandauti P.S. Case No. 311 of 2019 for the offence registered under Section 30(a) of the Prohibition and Excise Act, 2016.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that there is no recovery from the conscious possession of the petitioner. It is further submitted that name of the petitioner has surfaced on the basis of the confessional statement made before the by the co-accused.

Having considered the facts and circumstances of the

Patna High Court CR. MISC. No.15745 of 2020(2) dt.11-06-2020 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail on personal bond to the satisfaction of the Special Excise Judge, Gaya in connection with Chandauti P.S. Case No. 311 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
