2. This is the 2nd attempt of the petitioner for grant of bail in connection with Dumariyaghat P.S. Case No. 229 of 2023 registered for the offence under Section 395 of the Indian Penal Code and Section 27 of the Arms Act.
3. Earlier the bail application of the petitioner was rejected on 16.04.2024 in Cr. Misc. No. 7800 of 2024, the order dated 16.04.2024 reads as under:
Heard the learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks regular bail in a case registered for the offence under Section 395 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, a dacoity was committed in the C.S.P. Point and Rs. 2,48,000/- was looted.
4. Learned counsel for the petitioner submits that there is no recovery from the petitioner and no T.I. Parade has been held.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. I have considered the submissions of the learned counsel for the petitioner.
7. Materials have come during investigation to connect the petitioner with the crime. Petitioner is accused in five more cases and he has been identified in the CCTV Footage.
8. Since the petitioner has been identified as one of the dacoit who committed crime and his face was captured in the CCTV Footage, I am not inclined to grant bail to the petitioner.
9. Accordingly, this application for regular bail is dismissed. The court below is directed to expedite the trial of the petitioner.
4. In the trial there are seven charge-sheeted witnesses in this case and one witness has been examined.
5. Considering the fact of the case that the trial has already started, I am not inclined to grant regular bail to the
Patna High Court CR. MISC. No.17916 of 2025(5) dt.21-11-2025 3/3 petitioner. Accordingly, this application for regular bail is hereby rejected. The S.S.P, East Champaran is directed to ensure the examination of the witnesses.
