The petitioner is in custody in connection with Bihiya (Bahoranpur O.P.) P.S. Case No. 294 of 2017 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody in connection with seizure of 406 liters liquor. Learned counsel submits that nothing was recovered from conscious possession of the petitioner. Petitioner is in custody since 25.05.2018.

Considering the fact that nothing was recovered from possession of the petitioner and petitioner has remained in custody for more than one and half months, the petitioner, named above, is directed to be released on bail on furnishing

Patna High Court Cr.Misc. No.41317 of 2018(2) dt.12-07-2018 2/2 bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bhojpur at Ara in connection with Excise Case No. 5362 of 2017.
