11. 05-12-2016 Heard Sri Rabindra Prasad Singh, learned counsel for the petitioner, Mr. Ashlam Ansari, learned Addl. Public Prosecutor as well as Sri Pankaj Kumar, learned counsel, who has appeared on behalf of opposite party no. 2.

Earlier, the matter was referred to the Mediation Centre. A report of the Mediator has been received, which is kept at flag 'C'. The report indicates that both the parties had agreed for one time settlement and thereafter, on last four dates, the petitioner has not appeared before the Mediator.

In view of report of the Mediator as well as nonappearance of the petitioner before the Mediator for about four dates, there is no reason to keep the matter pending. The petition stands disposed of.

No.29912 of 2015 (11) dt.05-12-2016 2/2 However, it is observed that if within a period of six weeks from today, any joint petition is filed for settling the dispute in between the parties, the learned court below, without being prejudiced with this order, may examine the same and pass appropriate order on such petition in accordance with law, preferably within six weeks thereafter. It is made clear that this Court has not recorded any opinion on the merit of the case. The petition stands disposed of.

In view of disposal of this petition, the interim order of stay dated 04-08-2015 passed by this Court stands automatically vacated.
