The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 467, 468, 471 and 414/34 of the Indian Penal Code pending in the learned court below.

As per the prosecution case, petitioner along with other co-accused is involved in tempering with the Chesis number of the tractor.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that one person was apprehended on spot who disclosed the name of the petitioner. He submits that there is no concrete evidence as yet showing the petitioner's

Patna High Court CR. MISC. No.18667 of 2023(3) dt.23-06-2023 2/2 involvement in the alleged offence. He further submits that petitioner has got eight criminal antecedents as stated in para-3 of the bail application.

Per contra, learned APP for the State vehemently opposing the bail application and submitted that the allegation levelled as the petitioner is serious in nature. Hence, he does not deserve anticipatory bail.

Considering the nature of the offence, I am not inclined to enlarge the petitioner on bail in connection with Gaunaha P.S. Case No. 205/2022. Accordingly, his prayer for anticipatory bail is hereby rejected.
