JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302,201, 379 and 34 of the Indian Penal Code.

It is alleged by the informant that on 27.04.2014 her husband Chandradeo Yadav had gone to mobile tower for serving his duty as usual. The technician of the tower company came to her and stated about the absence of her husband at the tower whereupon her son went to verify the presence of her husband and in course of search the dead body of her husband was recovered from the maize crop field of Dr. Shaktinath Jha. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The name of the

There is no motive also alleged against this petitioner for committing the alleged offence. On behalf of the State, it has been submitted that the petitioner is not named in the FIR and from perusal of the case diary, it appears that no motive has been alleged against him. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Supaul in connection with Chhatapur P.S.Case No.112 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
