The petitioners apprehend their arrest in registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Sections 3(i)(x) of the SC/ST (POA) Act, 1989.

The informant alleged that the petitioners came to block the drainage and on protest Santosh Sah petitioner no. 1 assaulted the informant with Khanti on his head. Santosh Sah petitioner no. 1 also assaulted the wife of the informant on her head. It is submitted that the informant had made drainage pipe on the land of the petitioners. A counter version being Complaint Case No. 654 of 2014 is filed. The informant was not examined by any doctor. Poonam Devi wife of the informant filed

Patna High Court Cr.Misc. No.27830 of 2015 (2) dt.23-07-2015 2/2 SC/ST Hajipur P.S. Case No. 08 of 2015 for the same occurrence. Considering the facts aforesaid that the dispute occurred due to flow of drainage water and as submitted that there is no injuries, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Bidupur P.S.
