For the Petitioner/s : Mr Amarnath Jha, Advocate For the Opposite Party/s : Mr Raj Ballabh Singh, APP ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 25-05-2016 The petitioner, being the husband, apprehends arrest in connection with Complaint Case No 496 of 2014 filed by his wife under Sections 323, 498A, 406, 504 of Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act, pending before Subdivisional Judicial Magistrate (SDJM), Saharsa. Learned counsel for the petitioner submits that the relationship of the husband and wife was estranged from before inasmuch as on 15.01.2013, the petitioner had already filed an application before the Principal Judge, Family Court, Samastipur for dissolution of marriage in which wife had appeared and filed her written statement on 03.10.2013. Only to bring pressure on

Patna High Court Cr.Misc. No.22573 of 2016 (2) dt.25-05-2016 2/2 the husband, the present complaint has been filed in the year, 2014 in which cognizance was taken on 07.07.2015.

Be that as it may, in the event of his arrest or surrender within four weeks from today, the petitioner abovenamed shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of SDJM, Saharsa in Complaint Case No 496 of 2014 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
