Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 398/34 of the Indian Penal Code.

It is alleged that the 17 persons made attempt to commit dacoity in the house of the informant. One of the miscreants namely Babujan Mian @ Babujan Nut was caught hold, who disclosed the name of the petitioner as his associates.

It is submitted by the learned counsel for the petitioner that only on the confessional statement of coaccused the petitioner has been roped in the present case. Statement has been made in para-3 of the petition that

Patna High Court Cr.Misc. No.33956 of 2014 (2) dt.27-03-2015 petitioner has no criminal antecedent.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sugauli P.S. Case No. 348 of 2012, pending in the court of learned Additional Chief Judicial Magistrate, East Champaran at Motihari.

With this observation this application is disposed of.
