JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Brahmpur P.S. Case No. 62 of 2015 for the offences instituted under Sections 341, 323, 307/34 of the IPC and 25(1b)A and 26 of the Arms Act. The prosecution story, in brief, is that while the granddaughter of the informant, namely, Mithi Kumari, went outside, accused Vaishnavi Kumari was closing the door and when the said Mithi asked about closing the door, then the named accused Indu Devi as well as some other people of the house of the petitioner started assaulting her, in the meantime, the petitioner came down from the roof with revolver and fired two round on the husband of the informant with intent to kill him which hit on the hand and buttock due to which he became injured and thereafter the
Patna High Court Cr.Misc. No.28063 of 2015 (3) dt.29-09-2015 2/2 petitioner fled away and when the nearby people came and taken him for treatment. Further it is alleged that one cartridge was fallen at the door while the petitioner was retreating. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is a case and counter case. It is further submitted that both the parties belong to the same family and the compromise has been entered between the parties.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Brahmpur P.S. Case No. 62/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
