2. The petitioner seeks bail in connection with Pura P.S. Case No. 24 of 2024 instituted for the offences under Section 341, 323, 392/34 of the Indian Penal Code.
3. As per prosecution case, the Informant gave his tempo to one Deepak Kumar for running it on hire. Four unknown miscreants snatched the tempo from Deepak Kumar after tying his hand with belt. They also took Rs. 500/-, Aadhar Card and mobile phone from the driver. The name of the petitioner transpired in this case on the basis of the confessional statement of the co-accused Kaushal Kumar @ Akash Kumar.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.20878 of 2025(2) dt.22-04-2025 2/3 petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case merely on the basis of suspicion. The petitioner is not named in the F.I.R. and his name has transpired in this case in course of investigation on the basis of the confessional statement of the co-accused Kaushal Kumar @ Akash Kumar before the police which has no evidentiary value in the eye of law. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner. The recovery has been made from a poultry farm of the co-accused Niranjan Kumar @ Veranjan Kumar. No T.I.P. has been conducted till date. The petitioner has no concern with the alleged occurrence. The petitioner has three criminal antecedents and is languishing in judicial custody since 18.07.2024 without any rhymes or reason.
5. Learned counsel for the petitioner again submits that the co-accused persons have already been granted bail by a Co-ordinate Bench of this Court vide orders dated 23.10.2024, 10.01.2025, 14.02.2025 passed in Cr. Misc. Nos. 75477 of 2024, 89515 of 2024 & 2869 of 2025 respectively.
6. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
7. Having heard rival contention of both the parties
Patna High Court CR. MISC. No.20878 of 2025(2) dt.22-04-2025 3/3 and considering the entire facts and circumstances of the case, the period of custody of the petitioner and the prayer for bail being based on parity, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Pura P.S. Case No. 24 of 2024.
