2. The present application has been filed for quashing the order dated 25.01.2024 passed by the Chief Judicial Magistrate, Kishanganj in Bahadurganj P.S. Case No. 334 of 2023 whereby and whereunder he has cancelled the bail bond of the petitioner for the offences punishable under Sections 323,341,354,379,498(A),504,506/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
3. It has been submitted by the learned counsel for the petitioner that onerous condition was imposed for physical appearance on each and every date while the petitioner was
Patna High Court CR. MISC. No.20181 of 2024(2) dt.19-08-2024 2/2 granted bail bail along with the complainant.
4. The complainant could not appear along with the petitioner therefore, the bail bond has been cancelled.
5. It has been submitted by the learned counsel for the petitioner that on the next date fixed, he will appear along with his wife.
6. In these circumstances, the order dated 25.01.2024 passed by the Chief Judicial Magistrate, Kishanganj in Bahadurganj P.S. Case No. 334 of 2023 is set aside.
7. The petitioner will remain on the same bail bond subject to the condition that he will appear on the next date along with his wife.
