This application, for grant of anticipatory bail, arises out of Sitamarhi Police Station Case No. 195 of 2018, disclosing offences under Sections 363 and 366A of the Indian Penal Code and Sections 4/6 of the Protection of Children from Sexual Offences Act, 2012.
Considering the statement of the victim recorded under Section 164 of the Code of Criminal Procedure, 1973, certified copy of which has been brought on record by way of Annexure 2 to this application, this application is allowed. Patna High Court CR. MISC. No.17646 of 2019(2) dt.26-03-2019 2/2 released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO, Sitarmarhi, in connection with Sitarmarhi Police Station Case No. 195 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
