JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 10-07-2015 By order dated 27.3.2015 the petitioner was directed to be released on bail in Jamalpur (Badgaon) P.S. Case No.12 of 2014 in the event of arrest or surrender within six weeks from the date of passing of the order.

It has been contended that the petitioner is an old and infirm lady and is suffering from various ailments. During the intervening period of six weeks, she was confined to bed and, as such, could not surrender before the learned Chief Judicial Magistrate in compliance with the aforesaid order dated 27.3.2015.

The instant application under section 482 of the Code of Criminal Procedure has been filed for modification of the aforesaid order dated 27.3.2015.

I have heard learned counsel for the petitioner and

Patna High Court Cr.Misc. No.30588 of 2015 (2) dt.10-07-2015 2/2 learned counsel for the State.

On the facts and in the circumstances of the case, the prayer is allowed.

The period of six weeks granted for appearing before the Court of Chief Judicial Magistrate, Benipur, Darbhanga and furnishing bail bond vide order dated 27.3.2015 passed in Cr. Misc. No.41489 of 2014 is extended for further four weeks. (Ashwani Kumar Singh, J) Md.S./- U T
