The petitioner apprehends her arrest in a case registered under section 302/34 of the Indian Penal Code. The father of the deceased alleged that his daughter Punam Kumari was married with one Santosh Kumar about 13-14 years ago. Punam has got three children but her husband was torturing her. The informant further alleged that all the accused persons killed the deceased.
It is submitted that the police after investigation submitted charge-sheet in the case under section 306 of the Indian Penal Code but the learned Chief Judicial Magistrate took cognizance under section 302/34 of the Indian Penal Code. The petitioner is sister-in-law of the deceased and has no concern with the family affairs of the deceased. It transpired during the course
Patna High Court Cr.Misc. No.34821 of 2014 (2) dt.11-03-2015 of investigation that the victim committed suicide after jumping into a well.
Considering the facts aforesaid, the above named petitioner, who is sister-in-law of the deceased, in the event of arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur, in connection with Vidyapatinagar P.S. Case No. 95/2012 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973. (Prabhat Kumar Jha, J) Amin/- U
