JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 10.9.2018 passed in Cr.Misc.No. 45446 of 2018 and there is direct allegation against the petitioner if firing and due to which the deceased succumbed to the injuries.

Submission of learned counsel for the petitioner is that he is in custody since 3.12.2016 and charge has been framed in the year 2018 but as yet there is no substantial progress in the trial.

Heard learned APP and perused the report, from which it appears that out of eight charge-sheeted witnesses only two have been examined and non-bailable warrant has been issued against remaining charge-sheeted witnesses.

However, learned trial court is directed to expedite the trial and at the same time the Superintendent of Police, Begusarai is directed to ensure the presence of the witnesses in court on the date fixed, so that the trial may be concluded at the earliest.

With the above observation, this application is dismissed.
