Petitioner No.2, Sudina Devi @ Sudina Jha apprehends her arrest in Runnsaidpur P.S. Case No.27 of 2020, registered under Sections 304(B), 120(B) and 201 of the Indian Penal Code.
The brother of the deceased alleged that he married his sister with Shakti Jha two years ago but immediately thereafter all the accused persons were torturing his sister due to non-fulfillment of additional demand of dowry. On 13.01.2020, Mukesh Jha informed the informant on his telephone that the
Patna High Court CR. MISC. No.15234 of 2020(5) dt.20-01-2021 2/3 sister of the informant got burn injuries on account of electrocution and she was under treatment of Dr. Amit Kumar. The informant tried to video call her but he did not succeed. When the informant came from Delhi, the informant found that the accused persons hurriedly cremated the dead body of his sister.
Mr. Dinesh Jha, the learned counsel for the petitioner submits that the deceased was not happy with her husband. She was more educated than her husband. It is further submitted that the deceased accidently got electrocution. It would appear from perusal of the description of the place of occurrence that the entire electric wire was burnt due to high voltage and on account of such, the deceased also caught fire in her quilt and consequently she died. The mother and the father of the deceased filed petition that their daughter did not have any complaint of ill-treatment at the hands of the petitioner and other in laws but it appears that the deceased died of burn injuries within two years of her marriage and her dead body was also hurriedly cremated. No family member was informed. The witnesses have also stated that the petitioner and others were torturing the deceased due to non-fulfillment of additional demand of dowry. Patna High Court CR. MISC. No.15234 of 2020(5) dt.20-01-2021 3/3 inclined to enlarge the petitioner no.2, namely, Sudina Devi @ Sudina Jha on anticipatory bail. Accordingly, the prayer for anticipatory bail of petitioner no.2, namely, Sudina Devi @ Sudina Jha is rejected.
