JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 420 of the Indian Penal Code and later on Sections 467, 468, 471 and 120(B) of the Indian Penal Code were added.
It is alleged by the informant that on 16.10.2013 the accused persons came at his residence and had a talk with his wife that they have established an organization and if any one deposit any amount in one lump sum, the organization will pay double of the deposited amount. The wife of the informant gave Rs. 3,00,000/- to the accused and put signature on stamp paper. After two months when the accused persons did not make any payment the informant approached to the accused but they did not
Patna High Court Cr.Misc. No.26273 of 2015 (2) dt.21-07-2015 2/2 pay the amount. The accused persons committed forgery and misappropraited money of the informant's wife. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case due to mistake of fact. It is further submitted that the petitioner is ready to deposit an amount of Rs. 15,000/- in the court below, which shall be subject to final disposal of the case. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, the above named petitioner is directed to deposit an amount of Rs. 15,000/- in the court below, which shall be subject to final disposal of the case. Let in the event of his arrest or surrender in the court below within a period of four weeks, the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Tikapatti P.S.Case No. 88 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
