The petitioners seek bail in connection with Nautan P.S. Case No. 243 of 2017 dated 21.06.2017 instituted for the offences under Sections 147, 148, 149, 341, 342, 323, 384, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

The informant has alleged that petitioners were demanding Rs. 50,000/- as extortion for permitting him to undertake the work of filling of soil on the road. On the date of the occurrence, it is alleged that the petitioners, who are family members, forcibly kept the informant under confinement and assaulted him. Only on the timely arrival of the police, the

Learned counsel appearing for the petitioners has stated that the allegations are absolutely false. In fact, there was some attempt on the part of the informant to cut the standing crops in the field of one of the petitioners, for which a complaint case was filed and, therefore, the present case has been lodged against the petitioners. The injuries sustained by the informant appear to be simple in nature.

The petitioners are in custody since 24.07.2017. Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioners. The petitioners, above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P.S. Case No. 243 of 2017.
