Petitioner seeks regular bail in connection with Jamhor PS Case No. 19/2022 registered for the offence punishable under Sections 30(a) of Bihar Prohibition & Excise Act, 2018.
The police recovered 19.515 litres of IMFL from a tempo bearing Registration No. BR26A3663 and arrest two accused persons sitting therein.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of disclosure of his name by arrested accused persons. No illicit liquor has been recovered from conscious possession of the petitioner or from the vehicle belonging to him. Petitioner has got no concern with tempo from where recovery of illicit liquor
Patna High Court CR. MISC. No.17453 of 2022(2) dt.25-05-2022 2/2 has been made. The petitioner is in custody since 03.03.2022. Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact petitioner's name has figured in this case on the basis of disclosure of his name by arrested accused persons, no illicit liquor has been recovered from his conscious possession or from the vehicle belonging to him, petitioner is in custody since 03.03.2022, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, IX-cumSpecial Judge, Excise Court-II, Aurangabad (Bihar) in connection with Jamhor PS Case No. 19/2022.
