JUSTICE ARUN KUMAR ORAL ORDER 18-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Dhaka Pach Pakari PS Case No. 145 of 2017 registered under Section 376 of the IPC and Section 6 of POCSO Act.
Allegation in brief is that the informant's 11 years old daughter was raped by the petitioner.
Submission of the learned Counsel for the petitioner is that charge has been framed in this case and if the trial court does not conclude the trial within six months the petitioner may renew his prayer for bail.
Having considered the aforesaid facts, circumstances and the nature of the offence the prayer for bail of the petitioner is refused. However, the trial court is directed to expedite the trial on day to day basis and conclude the same at the earliest preferably within a year.
