Inter alia, the allegation, in the first information report, is that the petitioner had issued a cheque of Rs 11 lacs to the informant which, upon being deposited in the Bank, was dishonoured for lack of funds.

Having heard the learned counsel for the petitioner, who does not deny that the cheque that was issued was the cheque of petitioner's account, it was duly signed by the petitioner, I am not inclined to entertain this application. Prayer for anticipatory

Patna High Court Cr.Misc. No.22435 of 2016 (2) dt.25-05-2016 2/2 bail of petitioner is rejected.

However, the petitioner may surrender before the Court below and pray for bail and if he does so, his prayer for bail shall be considered on its own merit without being prejudiced by this order.
