JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This is an application for grant of anticipatory bail in connection with Charpokhari P.S. Case No. 207 of 2018, disclosing offences under Sections 341, 323, 326, 354(A), 379 and 34 of the Indian Penal code.

Allegation against the petitioner is of giving axe blow on the head of the informant causing injury.

Submission of learned counsel for the petitioner is that he is family member of the informant and there is land dispute between the parties for which he has falsely been implicated in this case.

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner stating that the injury is on the head and opinion is kept reserved.

Having heard both sides, in such view of the matter, I

No.16262 of 2019(4) dt.06-05-2019 2/2 am not inclined to grant privilege of anticipatory bail to the petitioner, rather he should surrender before the court below and make prayer regular bail which shall be considered on the basis of materials available on record, specially the nature of injury. Accordingly, this application is dismissed.
