2. The petitioner-institution, through its Nodal Officer, has approached this Court, seeking the following relief(s):- "i). For issuance of an appropriate writ\writs, order\ orders, direction\ direction in the nature of mandamus directing the respondent authorities to send the Pre

2/5 Admission mandatory Tuition Fee of near about 148 students of B Tech Students for sessions 2013-14, 2014-15 and 2016-17 to the petitioner's Institution Account in pursuance of Memo No.-4\ Nidhe-PravishokottarChhatravriti-140-01/2014-165, Patna dated 27.01.2014 issued by the Principal Secretary, SC/ST Welfare Department, Bihar, Patna.

(ii). For issuance of an appropriate writ\ writs, order\orders, direction directions in the nature of mandamus directing the respondent authorities to decide the representation dated 16.01.2026 which was send through Registered post (Annexure P\8) in accordance with law within short span of time. (iii). For grant of any relief(s) the petitioner would be found entitled to in the facts and circumstances of the case."

Learned Advocate for the petitioner submits that the petitioner-Institution admitted students and imparted B.Tech. education during the academic sessions 2013-2014, 2014-2015 and 2016-2017 pursuant to the policy decisions and directions issued by the State Government from time to time. It is contended that although the Institution duly imparted education to the eligible students, the mandatory tuition fee payable under the relevant Government scheme in respect of the aforesaid students has not been released till date. 3/5 that the petitioner has repeatedly approached the competent authorities and has also submitted a detailed representation ventilating its grievance; however, no final decision has yet been taken.

4. A counter affidavit has been filed on behalf of Respondent Nos. 1, 2 and 6. Referring to paragraph 9 thereof, learned Advocate for the State submits that, vide Memo No. 1384 dated 29.04.2026, the petitioner-Institution was called upon to furnish student-wise records, including enrolment forms, attendance registers maintained by the Institution, bona fide certificates, original scholarship application forms, and duly attested copies of the relevant mark sheets, so as to facilitate verification of the genuineness of the admissions and the eligibility of the students under the concerned scholarship scheme. It is the stand of the respondents that the requisite documents have not been furnished by the petitioner till date.

Having considered the rival submissions advanced on behalf of the parties, this Court finds that there is no dispute that the documents sought by the respondent authorities under Memo No. 1384 dated 29.04.2026 are essential for verifying the genuineness of the admissions as well as the admissibility of the scholarship and tuition fee claims under the applicable

4/5 Government scheme. In the absence of such verification, the claim of the petitioner cannot be effectively processed by the competent authority.

Accordingly, this Court deems it fit and appropriate to dispose of the present writ petition with a direction to the petitioner-Institution to submit an appropriate application before the Director, SC/ST Welfare Department, Government of Bihar, Patna, along with all the requisite records and documents as called for under Memo No. 1384 dated 29.04.2026, preferably within a period of four weeks from today.

Upon receipt of the petitioner's application along with all the requisite documents, the Director, SC/ST Welfare Department, or any other competent authority authorized in this regard, shall verify the records, consider the petitioner's claim in accordance with law, and pass a reasoned and speaking order, preferably within a further period of eight weeks thereafter.

It is further observed that in the event the petitioner's claim is found to be genuine and admissible upon such verification, the consequential monetary benefits, including release of the admissible tuition fee, shall be sanctioned and disbursed expeditiously in accordance with the applicable rules and Government policy, within the period stipulated.
