JUSTICE JITENDRA KUMAR ORAL ORDER 08-07-2026 At the outset, it would be pertinent to mention that out of three Petitioners, the petition on behalf of Petitioner Nos.1 & 2 has already been withdrawn and only Petitioner No.3 is here for grant of anticipatory bail.
2. Heard learned counsel for the petitioner and learned APP for the State.
3. The petitioner seeks bail, apprehending his arrest, in connection with Yadavpur P.S. Case No.232 of 2025, dated26.11.2025, registered for the offences punishable under Sections 191(2), 191(3), 115(2), 118(1), 118(2), 117(2), 109, 352, 351(2) of the B.N.S.

4. As per allegation, the Petitioner and other coaccused have assaulted the Informant and his family members by lathi, danda and rod, causing injury on the head and breaking the hand of one of his family members.
5. Learned counsel for the petitioner submits that the Petitioner is innocent and has falsely been implicated in this case. He further submits that as a matter of fact, there is a dispute regarding public rasta (pathway) between the Petitioner and the Informant side and on account of this dispute, altercation took place between the two groups, leading to injury on both the sides and lodging of case and counter case. In fact, the FIR lodged by the Petitioner side was prior to that of the Informant side. His FIR bears Yadavpur P.S. Case No.231 of 2025 registered for the offences punishable under Section 109 and other allied sections of the IPC. He further submits that as per specific allegation, injury was caused by the Petitioner to Dinesh Sah, whose injury as per the injury report is assumed to be simple in the opinion of the doctor as per the case diary.
6. It is also stated in paragraph no. 2 of the bail petition that the petitioner has not moved this Court earlier either for anticipatory bail or regular one in the instant case.
7. It has further been stated in paragraph no.3 of the
3/4 bail petition that the petitioner has no criminal antecedents.
8. However, learned APP for the State vehemently opposes the prayer of the Petitioner for bail.

Considering the case and counter case and injury on both the sides, this petition is allowed, directing the petitioner, above-named, to be enlarged on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below, in connection with Yadavpur P.S. Case No.232 of 2025, subject to the conditions as laid down under Section 482 (2) of the B.N.S.S., 2023 and on the following conditions:
(i) In case, it is brought to the notice of the court below that the petitioner has any criminal antecedents, learned court below shall cancel the bail bonds of the petitioner after hearing him and getting satisfied that the petitioner has concealed his criminal antecedents despite his knowledge of the same.
(ii) In case, it is brought to the notice of the court below that statement regarding previous bail petition is wrong,
