The petitioner seeks bail in connection with Khagaria (Gangaur) P.S. Case No. 857 of 2018 instituted for the offence under Sections 406, 419, 420, 467, 468 & 34 of the Indian Penal Code.

As per the prosecution case, the petitioner is alleged to have taken loan from Union Bank of India, Jahagir on the basis of counterfeit paper of Land Possession Certificate (LPC). The petitioner made benefits and committed cheating with the said Bank.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17-11-2023. Petitioner is

Patna High Court CR. MISC. No.19240 of 2024(2) dt.18-03-2024 2/2 stated to be man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. He further submits that petitioner has deposited principal amount of Rs. 30,000/- on 23-11-2023. Other co-accused have been granted bail by this Court, vide order dated 05-12-2023, passed in Cr. Misc. No. 77595 of 2023. Similar co-accused have been granted bail by a Co-ordinate Bench of this Court vide Annexure-3 Series to this application.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Khagaria (Gangaur) P.S. Case No. 857 of 2018.
