JUSTICE VIKASH JAIN ORAL ORDER 28-07-2015 Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 149, 341, 323, 325, 307, 379 of the Indian Penal Code registered in connection with Chand P.S. Case No. 32 of 2015.

3. It is submitted that the petitioners have been falsely implicated and in any event the injury report along with supplementary injury report did not entirely support the accusations or the nature of assault attributed to the petitioner no.1.

4. Considering that the informant has suffered

Patna High Court Cr.Misc. No.27574 of 2015 (2) dt.28-07-2015 grievous injury on the leg which corroborates such accusations in the First Information Report, this Court is not inclined to grant privilege of anticipatory bail to the petitioner no.1 (Shailesh Kumar Singh @ Shailesh Singh @ Sonu Singh) and his prayer for bail stands dismissed.

5. As regards petitioner no. 2 there is nothing in the injury report to suggest any injury even a mark on the neck of the informant to support the accusation against the petitioner no. 2. As such, in the event of the arrest or surrender of petitioner no. 2 (Vijendra Singh) before the court below within six weeks from the date of communication of this order, let the above named petitioner no. 2 be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Chand P.S. Case No. 32 of 2015 subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Vikash Jain, J) Chandran U T
