This application is for grant of regular bail in connection with Muffasil P.S.Case No.340 of 2018for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per FIR, allegation against the petitioner is that he received information that the petitioner is roaming in injured condition and thereafter the police caught hold the petitioner with one loaded Pistol, one cartridge of 315 bore and one empty cartridge has also been recovered. Further 91 bottle of 180 ml. each foreign liquor has also been recovered. Apart from that the petitioner is accused in 13 other cases. Submission of the learned counsel for the
Patna High Court CR. MISC. No.19153 of 2019(3) dt.21-05-2019 2/2 petitioner is that he has been falsely implicated in this case and in four cases he has been acquitted. He is in custody for about one year.
Heard learned A.P.P. , who has opposed the prayer for bail..
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial .
With the above direction, this application is dismissed.
