The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 385, 447, 379, 504, 506/34 of the Indian Penal Code 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. It is alleged that the accused persons assaulted the informant abusing by calling caste name and coaccused Anirudh Mehta snatched gold chain from the neck of the informant.
It is submitted by the learned counsel for the petitioners that for the occurrence of 08.12.2013 the First Information Report was registered on 04.12.2013.
Patna High Court Cr.Misc. No.33943 of 2014 (2) dt.27-03-2015 Admittedly, the occurrence took place at the door of the informant, hence it may not be treated to be a place of public view. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Statement has been made in para-10 of the petition that informant's side have not received any injury. Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sonbarsa (Kashnagar) P.S. Case No. 183 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
