JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 452, 323, 354(A)(II), 504, 506 and 34 of the Indian Penal Code.

The prosecution story, in brief, is that on 18.4.2015 at 11.30 P.M., the accused persons came at the house of the informant and forcibly started to drink wine sitting on the roof and when objection was made they threatened with dire consequence. It is alleged that the accused persons returned back at 1.00 A.M At 3.00 A.M. at night accused Pinku Yadav entered inside the house through window and drive away the informant from the house and caught the hand of the sister of the informant with bad intention.When the sister of the informant objected he assaulted

Patna High Court Cr.Misc. No.26278 of 2015 (2) dt.20-07-2015 2/2 her with firsts and slaps. She hided herself in Bahiyar and in morning she informed the informant on mobile. It has been submitted on behalf of the petitioner that the main allegation is against Pinku Yadav, who is alleged to have misbehaved with the sister of the informant. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Bhagalpur in connection with Sabour ( Goradih) P.S.Case No. 68 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
