JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-07-2018 Heard learned counsels for the petitioner and the State. Ashamed Petitioner apprehends arrest in connection with Maniyari P.S. Case No. 238 of 2017 registered for the offence punishable under sections 304B/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner alongwith his family members have been falsely implicated in the present case. Petitioner never demanded any dowry nor tortured the deceased. As a matter of fact, the deceased was not happy with the marriage and she might have committed suicide.

Learned Addl. P.P. appearing for the State opposes the prayer for bail of the petitioner and submits that there is specific allegation of demand and torture against this petitioner

Patna High Court Cr.Misc. No.40264 of 2018(2) dt.19-07-2018 2/2 and his family members. Moreover, petitioner being the husband was very much responsible for keeping his wife with full honour and dignity in which he failed, and as such, he does not deserves to be granted the privilege of bail.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.
