The petitioner apprehends his arrest in a case registered under Sections 498(A)/34 of the Indian Penal Code and Sections 3 / 4 of the D.P. Act.

The petitioner-husband and the informant-wife are present in chambers along with Sri Suraj Narain Prasad Sinha, learned senior counsel for the petitioner, and Smt. Poonam Sinha, learned counsel for the informant. Efforts were made for reconciliation. The husband and the wife made allegations against each other. The couple has got a child, aged about two years. The wife appears to be reluctant to restore the marital relation with her husband as she is very much scared of the behaviour met to her by her husband during her stay at her matrimonial house although the

Patna High Court Cr.Misc. No.27329 of 2015 (3) dt.27-07-2015 2/2 husband is ready to keep his wife. It is agreed that the husband be granted provisional bail for six months and during this period the husband and the wife with their well wishers shall make efforts for resolution of dispute.

Considering the facts aforesaid, the above named petitioner is directed to surrender in the court below within four weeks from today and the court below shall, after issuing notice to the informant, grant provisional bail to the petitioner for six months on furnishing bail bond in the sum of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Indrani Kisku, Judicial Magistrate, Patna in Shastri Nagar P.S. Case No. 691 of 2014, corresponding to G.R. No. 7472/14.

The court below shall make all efforts for reconciliation of the dispute between the husband and the wife. If the dispute is resolved amicably between the parties, the provisional bail granted to the petitioner shall be confirmed. In case the dispute is not resolved, the court below shall pass orders on the prayer for provisional bail of the petitioner on its own merit in accordance with law.
