JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-10-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner apprehends his arrest in a case registered for the offences punishable under Section341, 323, 324, 384, 385, 307, 427, 504 & 506/34 of the Indian Penal Code.
While the informant with his elder brother was going to marriage hall, which is under construction, and when they reached near the marriage hall, the petitioner asked them that why they had not given him Rs. 1,00,000.00 in Rangadari and started the construction work of marriage hall. In the meantime, petitioner took knife from his waist and inflicted knife blow in the stomach of his brother and he sustained injury in the left side of the stomach. When the informant tried to save

In the meantime, the sister and mother of the petitioner damaged the marriage hall and also abused them. On hulla, the nearby people came and brought the injured to P.H.C., Kuchaikote. It is also alleged that the petitioner was sending message of threatening on mobile and face book.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due to enmity. There is case and counter case between the parties. The mother of the petitioner has lodged a case being Kuchaikote P.S. Case No.84 of 2019 against the petitioner and his family members. Informant has sustained four injuries caused by hard and blunt substance but all are simple in nature. It is further submitted that informant and petitioner are neighbours and there is no question of demanding the 'Rangdari'. He has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two
