JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,325,504 and 506 of the Indian Penal Code and sections 3(1) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that on refusal to reap the crop of the petitioner the petitioner assaulted the informant indiscriminately and abusing by calling the caste name.

It is submitted by the learned counsel for the petitioner that the informant has not received any injury. Statement to the aforesaid effect has been made in paragraph 7 of the petition.

Patna High Court Cr.Misc. No.26294 of 2015 (2) dt.17-07-2015 2/2 Statement has also been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Bhabua SC/ST P.S. Case No. 20 of 2015 pending in the court of learned CJM, Kaimur at Bhabua.

This application is disposed of with the aforesaid observation/direction.
