Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 332, 337, 353, 307, 427, 379, 225, 419, 420, 504, 273 of the Indian Penal Code, 47A of the Excise Act and 3/4 of the Prevention of Damage to Public Property Act, 1984. The prosecution case is that from the shop of petitioner 192 bottles of country made liquor and 300 glasses were recovered. Excise officials were attacked by a mob of fifty persons while conducting raid.
It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the place of seizure belongs to the petitioner and accusation of attacking on the Excise Officials is not specific against the
Patna High Court Cr.Misc. No.23081 of 2016 (2) dt.23-05-2016 petitioner. Co-accused Surendra Baitha has been granted bail by a Coordinate Bench of this Court vide Cr. Misc. No. 18914 of 2016.
The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Goreyakothi P.S. Case No. 13 of 2016, pending in the court of learned Chief Judicial Magistrate, Siwan.
With the above observation this application is disposed of.
