The petitioner apprehends arrest in a case registered for the offence punishable under sections 379/420 and other ancillary sections of the Indian Penal Code.

Petitioner is alleged to have assaulted the informant with fists and slaps and he took away golden chain of Rs.50,000/-.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, petitioner had supplied vehicles to the informant on certain conditions but suddenly he demanded more vehicles which was refused by the petitioner due to which altercation took place with the informant. Present case is of civil

Patna High Court CR. MISC. No.17202 of 2022(2) dt.29-08-2022 2/2 nature and no chit of paper has been produced by the informant in support of the allegation. Petitioner has got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Mahua Police Station Case No. 741 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
