The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a), 35 and 38 of the Bihar Prohibition and Excise Act, 2016.

2.360 liters of foreign liquor is said to have been recovered from the Travera vehicle and the petitioner who happens to be driver of the said vehicle was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern either with the seized liquor. Petitioner happens to be driver of the vehicle in question and he had no

He has been falsely implicated in the case at the instance of his enemy by planting aforesaid recovery. He has no criminal antecedent and has been languishing in custody since 16.06.2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-VIth, Kaimur at Bhabhua in connection with Durgawati P.S. Case No. 229 of 2018.
