JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 363, 366(A), 504, 506, 34 of the Indian Penal Code.

It is a case of abduction of the minor daughter of the informant by all the F.I.R named accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The victim girl had love

Patna High Court CR. MISC. No.17366 of 2023(2) dt.16-05-2023 2/2 affairs with Md. Arif and she went along with him of her own volition. The victim in her 161 Cr.P.C statement did not whisper about the complicity of the petitioner in the alleged crime and raised specific allegation against Md. Arif that he committed rape several times upon the victim. The petitioner is languishing in custody since 18.11.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Sadar (Muffasil) P.S. Case No. 434 of 2021.
