The petitioners are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 147, 148, 420, 406, 323, 452, 380 of the Indian Penal Code.

Prosecution case is that one Sunita Devi, executed the sale deed with respect to the ancestral land of the complainant pertaining to Khata No.311, Plont No.391, in favour of the petitioners by impersonating one Ranjana Devi. When the complainant made protest for constructing the boundary wall on the land in question, the accused persons claimed that they have purchased the land. On 30.06.2016 at about 6.00 PM, the accused

Patna High Court Cr.Misc. No.24359 of 2016 (2) dt.31-05-2016 2/2 persons came to the house of the informant abused and made assault and thereafter committed theft.

It is submitted by learned counsel for the petitioners that in the background of 145 Cr.P.C. proceeding due to the land dispute between the parties, the present case has been lodged. The land in question was purchased on 11.05.2013 and the authorities were found possession over the land in favour of the petitioners. Considering the accusation being levelled in the background of land dispute, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya, in connection with Complaint Case No.1273/2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
