JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Kako Police Station Case No.282 of 2019 registered under Section 379 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the fardbeyan of the informant, the present case was instituted under Section 379 of the Indian Penal Code on 03.11.2019 against unknown. In course of investigation, the name of the petitioner surfaced through Spy, as detailed in paragraph-18 of the case diary. Thereafter, the police recorded the confessional statement of the petitioner as the petitioner was in custody in
Patna High Court CR. MISC. No.16081 of 2020(2) dt.05-06-2020 2/2 connection with Hulasganj P.S. Case No.171 of 2019 dated 25.11.2019 and remanded the petitioner in the present case on 06.01.2020.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge-I, Jehanabad, in connection with Kako P.S. Case No.282 of 2019. Out of the two sureties, one must be either parents or the close relative of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
