1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Kauwakol P.S. Case no. 480 of 2025 registered under sections 191(2), 191(3), 190, 329(3), 324(4), 324(5), 115(2), 118(1), 117(2), 109, 103(1) and 61(2) of the Bhartiya Nyay Sanhita, 2023.

3. As per the prosecution case, the ten named accused persons including the petitioner herein are said to have come variously armed and having assaulted the informant and the members of his family. While Umesh Sao is said to have assaulted Lakhan Sao who subsequently died in course of treatment, Rajendra Sao is said to have assaulted the informant and Dharmendra Sao is said to have assaulted Vimali Devi.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. He is in custody since 2.12.2025 and has no criminal antecedent.

5. The application for bail is opposed by learned APP for the State and learned counsel for the informant. Learned APP for the State referring to paragraph no. 104 of the case diary submits that the allegation of assault on the deceased Lakhan Sao is on both Umesh Sao as also one Dharmendra Sao. Learned counsel appearing for the informant submits that the petitioner is named in the FIR and there is direct allegation against him of having actively participated in the occurrence, having brutally assaulted the informant and the members of his family leading to death of Lakhan Sao. The witnesses have supported the prosecution case against the petitioner. The deceased has multiple injuries on him.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner being general and omnibus in nature, there being no specific allegations of assault against the petitioner so far as the deceased is concerned, the petitioner being in custody since 2.12.2025, chargesheet having been submitted in the case and

No.17298 of 2026(5) dt.08-07-2026 3/3 the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Kauwakol P.S. Case no. 480 of 2025 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Nawada.
