The Petitioners seek bail in Jogapatti P.S. Case No. 305 of 2017 registered for the offence punishable under Sections 448, 341, 323, 324, 354B, 504 and 506 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that the petitioners have been falsely implicated in this case. It has been further submitted that there is also delay of about seven days in lodging the FIR. There is no allegation of any specific overt act against the petitioners. Similarly situated co-accused person has been granted bail by a co-ordinate bench of this Court vide order dated 22.12.2017 in Criminal Miscellaneous

Patna High Court Cr.Misc. No.59124 of 2017(2) dt.12-01-2018 2/2 No. 55033 of 2017. The petitioner has got no criminal antecedent. Petitioner no. 1 is in custody since, 07.09.2017 and petitioner no. 2 is in custody since 12.09.2017. Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M. Bettiah, West Champaran in connection with Jogapatti P.S. Case No. 305 of 2017.
