JUSTICE PURNENDU SINGH ORAL ORDER 05-08-2025 Heard Mr. Kamlesh Kumar Pathak, learned counsel appearing on behalf of the petitioner; Mr. Amit Bhushan, learned AC to GP-17 for the State and Mr. Ritesh Kumar, learned counsel for the B.N. Mandal University.

2. The petitioner in paragraph no. 1 of the present writ petition has sought inter alia following relief(s), which is reproduced hereinafter:

"(i) To issue an appropriate order/s direction/s including a writ preferably in the nature of Mandamus commanding and directing upon the respondents to appoint the petitioner to the post of (Group-C) in the University in pursuant to advertisement No. BNMU-04/ 2014-15 published by the B.N. Mandal University, Laloo Nagar, Madhepura and had applied for the same.

(ii) To direct the respondents to appoint the petitioner to the said post who has qualified in the written

Patna High Court CWJC No.8468 of 2021(5) dt.05-08-2025 2/2 examination successfully.

(iii) To any other relief/s to which the petitioner is entitled in the facts and circumstances of the case."

In view of the provision contained in Section 4 (c) of the Bihar Reservation of Vacancies in Posts and Services (for Scheduled Castes, Scheduled Tribes and other Backward Classes) Act, 1991, I don't find to interfere in any manner with the selection process, which was initiated in the year 2014 and finally concluded in the year 2017. The petitioner has not been able to make out a case of discrimination.

4. Accordingly, the present writ petition stands disposed of.

5. It goes without saying that the petitioner may avail opportunity in future if any advertisement for appointment is advertised for the post to which he is entitled for. (Purnendu Singh, J) Niraj/- U
