The petitioner is languishing in custody since 12.01.2019 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution case that two accused persons including the petitioner were apprehended while travelling on a motorcycle, and from the alleged motorcycle, 90 litres of illicit country made liquor were recovered.
It is submitted by learned counsel for the petitioner that the petitioner has no concern either with the alleged motorcycle or with the seized illicit liquor, a statement to that effect has been made in paragraph no.7 of the petition. A statement has been made in paragraph no.3 of the petition that the petitioner is not

Learned APP submits that the petitioner was apprehended from the spot.
Considering the nature of recovery and period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District and Sessions Judge-cum-Special Judge, Nawada in connection with Roh P.S.
